Services
MapMyClinic, a brand of MBAFrog Web Services, provides digital marketing services to healthcare practices. The scope, price and timeline for each engagement are set out in your proposal, quotation or invoice, which together with these terms form our agreement.
Payments
Monthly services are billed in advance, and invoices are due within 7 days. Prices exclude GST, which is added as applicable. Ad spend is paid by the client directly to Google, Meta or other platforms from the client's own ad account. If an invoice remains unpaid 15 days after its due date, we may pause work after telling you. As a registered MSME, we may also claim interest on late payments under the MSMED Act, 2006.
Cancellation
To cancel monthly services, give us written notice (email or WhatsApp) at least 30 days before your next billing date, and we won't bill you for any later month. Fees already billed are non-refundable once that month's work has started. Website projects follow the payment milestones in the proposal. We may also end an engagement with 30 days' notice, or immediately if you ask us to publish unlawful content or don't pay; either way, we hand over your accounts and the work you have paid for.
Ownership
Your domain, website, Google Business Profile, social media pages and ad accounts belong to you and are set up in your name, with us added as managers. Once a project is paid in full, we assign to you the copyright in the website design and content we create specifically for you. Themes, plugins, stock images and fonts from third parties are licensed to you on their own terms. Our own tools and templates used across clients remain ours. If you leave, we hand over all logins and files for work you have paid for.
Your content and approvals
You confirm that the information, qualifications, photos and claims you give us are accurate, and that you hold the registrations and permissions needed to practise and advertise. Medical content is shared with you for review, and you approve it before publishing.
Advertising rules
We follow Google and Meta policies and write content with the professional codes for your system of medicine and Indian advertising law in mind, and we will tell you when we think something shouldn't be published. Compliance with the rules that govern your practice remains your responsibility, and we may decline to publish content we believe breaks them.
Results
We work to improve your visibility and enquiries, but no agency can guarantee rankings, reviews or patient numbers, because platforms like Google control their own results.
Case studies
We may describe our work for you and publish performance figures for your practice, such as profile views or rankings, as a case study or in proposals. Figures will be real, dated and not presented as typical, and we never publish patients' personal information. If you'd rather we didn't feature your practice, tell us in writing and we won't, and we'll remove anything already published within 7 working days.
Confidentiality
We keep your business information and account access confidential, except as needed to deliver the services or as described in these terms.
Patient data
Where we handle your patients' contact details, for example for review requests or reminders, you are the Data Fiduciary and we act as your Data Processor under the Digital Personal Data Protection Act, 2023. We use that data only on your written instructions (email or WhatsApp is enough), keep it confidential and secure, tell you promptly about any breach, and delete or return it when our work ends. You are responsible for having consent to contact your patients, including a parent's consent for patients under 18.
Indemnity
You will cover any claims, penalties or costs caused by information, claims or content you supplied or approved.
Liability
Our total liability for any claim relating to our services is limited to the fees you paid us in the three months before the claim. We are not liable for indirect losses, such as lost profits or patients, or for decisions made by Google, Meta or other platforms, such as suspensions or ad disapprovals. This limit does not apply to fraud, wilful misconduct, or liability that cannot legally be limited.
Events beyond our control
Neither of us is liable for delays caused by events beyond reasonable control, including platform outages and platform policy changes.
Changes to these terms
We may update these terms. Changes don't alter a proposal you have already accepted.
Governing law
These terms are governed by the laws of India, with courts in Bareilly, Uttar Pradesh having exclusive jurisdiction.
